Minnesota Workers' Compensation Law entitles employees to four classes of benefits when an injury occurs at work. The injury could have occurred on the job site or outside of the workplace. As the injured worker, you are entitled to compensation so long as the injury occurred in the scope of your employment. This would include injuries on company property, an on-the-job car or truck accident or workplace injuries at a construction site.

Minnesota requires employers to carry workers' compensation insurance either with a private insurer or be self-insured.

The four-tiers of benefits include:

(1) wage loss while you can not work or are limited in the number of hours you can work; in addition, severely injured workers may not be able to return to work at all and become permanently totally disabled and become entitled to long term wage loss compensation
(2) payment of your medical bills for surgery, therapy and/or medications;
(3) job counseling and job placement services if you can not maintain your employment due to your work injury; and
(4) permanent partial disability benefits if your injury is severe and reduced the function of an injured body part.

Workers' Compensation benefits may also be available to the dependents of those injured workers who die as a result of a workers compensation injury.

Like all insurance policies, workers' compensation insurers prefer to deny or limit claims. Sometimes, this means that legitimate workers' compensation claims are initially denied. If any portion of your claim has been denied, contact us immediately. We may advise you to promptly start a Workers' Compensation lawsuit, causing the insurer to accept your claim, or, obtaining a Court Order requiring payment of your benefits. Be aware that Insurers may at any time also hire doctors in a procedure known as an 'Independent' Medical Exam (IME) for the purpose of claiming the injured workers' injuries were minimal, trivial or pre-existing. If you have been scheduled for IME, call us immediately. The IME may be used by the Insurer to deny you the right to wage loss, surgery, job search assistance and/or permanent injury benefits.
